The following terms and conditions apply to all transactions on www.captureperfect.co.uk The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.

1. Status of Terms

1.1  These terms constitute a legal document (“the Agreement”), which sets out the rights and obligations of you as a purchaser (“you”), and those of Capture Perfect (“Capture Perfect”, “we” or “us”), in relation to the services and products offered by us through this site or any of the other sites owned by us. By registering for Capture Perfect services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services.

 1.2 You agree to:

 1.2.1 provide true, accurate, current and complete information about you as prompted by our registration form (such information being the “Registration Data”).

 1.2.2 maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Capture Perfect has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Capture Perfect has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the Capture Perfect site (or any portion of it).

2. Place of performance and applicable law.

Capture Perfect is registered in England. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. Capture Perfect makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement.

 You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement.

3. Placing an order

3.1 When placing an order with Capture Perfect you have to first agree with the terms and conditions prior to the completion of your order.

3.2 We consider the contract of sale to be formed at the point of despatch by us of your goods.

3.3 Goods supplied to you by Capture Perfect will correspond with their prices and description (subject to E & OE). If at any time this is not the case Capture Perfect will give you the right to reject the goods within a reasonable time period for a full refund.

3.4 In the unlikely event that an incorrect price is shown on our website Capture Perfect reserves the right to abstain from fulfilling the order at that price. You will, of course, be notified, and at which point you will be informed of the correct price, and given the choice to proceed with the order. As our buying prices are subject to change, we may on occasion be unable to supply at the advertised website price, in this instance, we will contact you and inform you of the correct pricing where you will have the option to proceed with the order or cancel the order with a full refund. 

3.5 We can only accept payment from payment cards registered in the United Kingdom. 

3.6 Pre-Orders placed with Capture Perfect are done so based on the price information we have at the time of announcement. Periodically pricing can change prior to product launch and all pre-orders are accepted as a non-binding agreement to supply at the specified price published when pre-order is placed.  All deposits are fully refundable at any point and any pre-order has the right to cancel

4.Where can I have my order delivered?

This depends on your payment method. If you are paying with a credit or debit card then we can only deliver your order to the registered address for the cardholder or to a UK registered business address. If you pay using PayPal then we will despatch goods to any address you have authorised within your account settings.

5.When do I qualify for Free Delivery?

All items over the retail price of £150 and under 30 kilos in weight qualify for free UK delivery. Any items that do not qualify will require postage fees paid by the customer.

6.Refund policy

Capture Perfect will not accept goods for credit or rectification unless such return has been authorised by Capture Perfect, and the goods are received by Capture Perfect in stock condition with original packaging.

6.1   Capture Perfect retain the right at our sole discretion whether to accept the return of the goods, or whether to rectify the goods or whether to issue a credit note in respect thereof.

6.2. Capture Perfect reserves the right to charge a restocking fee up to 20% on goods returned for credit that are not in stock condition. Where Capture Perfect have supplied goods to you, you must take reasonable care of the goods in your possession pending their return to Capture Perfect. Capture Perfect will only accept returned goods complete with their original packaging and which do not exhibit any signs of wear & tear. Any use of the delivered goods beyond that necessary to inspect the goods upon delivery, in accordance with the Consumer Contracts Regulations 2013, will invalidate your right to cancel the contract or may be subject to a restocking fee. When evaluating cameras you agree to keep shutter actuations (pictures taken) to an absolute minimum. As shutter actuations are measurable, products with excessive actuations are not considered to be new. We deem that an excess of 30 shutter actuations is beyond that needed to fairly inspect goods during your cooling off period and in such circumstances, reserve the right to apply a restocking fee.

6.3.  Goods shall be at the risk of the purchaser until actual receipt of the goods by Capture Perfect. The onus of proof of safe delivery shall rest with the purchaser.

6.4. All returned items must contain a copy of the original receipt and a returns number. All items returned to Capture Perfect by prearrangement and found to contain no fault, will be subject to up to 20% restocking charge (for goods returned outside the 14-day cooling-off period), providing the goods are in original stock condition. Any downward variation of this restocking charge shall be at the sole discretion of Capture Perfect. No credit shall be allowed for goods until they have been received.

7.Consequential loss

The extent of the Capture Perfect liability to the purchaser for any default or breach whatsoever and howsoever arising shall in no case exceed the invoice value of the goods and Capture Perfect shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser and whether direct, indirect, consequential, or however else arising.

8.Law

This contract is and shall be deemed to have been made in the UK and shall in all respects be governed by UK Law.

Capture Perfect shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightning, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.

9.What if my order is awaiting stock?

If the item is out of stock and there is an extended wait by the supplier, we will contact you to advise. You are welcome to exchange your item for an alternative product or request your order be cancelled and refunded.
